By using comcomm, you agree to these terms. Please read them — they are written in plain English and exist to protect both you and the platform.
1. What comcomm is
comcomm is an online marketplace that connects local businesses ("Advertisers") with community venues such as schools, parks, sports leagues, and faith communities ("Venues"). comcomm facilitates introductions and communications between the two parties. comcomm is not a party to any agreement, transaction, or placement that occurs between an Advertiser and a Venue.
comcomm does not guarantee that any placement will be completed, that any listing is accurate, or that either party will fulfill their commitments. All agreements are made directly between the Advertiser and the Venue.
2. Eligibility
You must be 18 years of age or older to use comcomm. By submitting an inquiry or posting a listing, you represent that you have the authority to enter into a binding agreement on behalf of yourself or your organization.
3. Venue listings
Venues are responsible for the accuracy of all information in their listings, including audience size, pricing, placement dimensions, and availability. comcomm does not verify listing information. Venues may not list:
- Spaces they do not have authority to monetize
- Placements that violate local zoning, school district, or municipal rules
- Content that is misleading, fraudulent, or discriminatory
comcomm reserves the right to remove any listing at any time, without notice or liability.
4. Advertiser inquiries
Submitting an inquiry does not constitute a booking or a binding agreement. A placement is only confirmed when both the Advertiser and Venue have agreed in writing (email is sufficient). Advertisers are solely responsible for ensuring their ad content complies with applicable laws and the Venue's content guidelines.
5. comcomm's service fee and payment processing
comcomm charges a flat 7% service fee on every completed booking. This fee is disclosed transparently before any transaction.
Card processing fees (charged by our third-party payment processor, currently Stripe) are not part of comcomm's service fee and are billed to the buyer as a separate, pass-through line item at checkout. These processing fees are determined by the payment processor (typically approximately 2.9% + $0.30 per transaction) and may change without notice. comcomm does not profit from card processing fees.
The buyer's total at checkout is the sum of: (a) the placement price set by the Venue, (b) comcomm's 7% service fee, and (c) the card processing fee passed through from the payment processor. All three components are itemized on the receipt.
6. comcomm's role — intermediary only
comcomm acts solely as a connection platform. We are not responsible for:
- The quality, placement, or display of any advertisement
- Any failure by a Venue to honor a placement agreement
- Any failure by an Advertiser to pay or deliver artwork
- Disputes between Advertisers and Venues of any kind
- Results, performance, or return on investment of any placement
7. Dispute resolution
If a dispute arises between an Advertiser and a Venue, comcomm may (at its sole discretion) attempt to assist in mediation, but has no obligation to do so and bears no liability for the outcome. Disputes between users and comcomm shall be governed by the laws of the State of Florida, USA. Both parties agree to attempt good-faith resolution before pursuing legal action.
8. Disclaimer of warranties
THE COMCOMM PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COMCOMM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS, OR LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF EYEYE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. COMCOMM'S TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT OF THE SERVICE FEE PAID BY YOU TO EYEYE IN THE 12 MONTHS PRECEDING THE CLAIM.
10. Intellectual property
All content on the comcomm platform (design, copy, code) is owned by comcomm. Listing content posted by Venues remains the property of the Venue, but by posting, the Venue grants comcomm a non-exclusive license to display that content on the platform. Advertisers retain ownership of their ad creatives.
11. Termination
comcomm may suspend or remove any user, listing, or inquiry at its sole discretion, without notice or liability, for any reason including violation of these Terms or activity that comcomm determines to be harmful to the platform or its users.
12. Changes to these terms
We may update these Terms as the platform evolves. Continued use after changes are posted constitutes acceptance. We will update the "last updated" date for material changes.
